TERMS AND CONDITIONS FOR SUPPLY
By submitting an order for Kids Activity Box/es (“Product”) with Together Time Limited (“Us” or “We”) on www.togethertime.co.nz (“Site”), you agree that you accept these specific terms of supply below, in addition to the Terms of Use / Privacy Policy on our Site.
WARNING: CHOKING HAZARD – SMALL PARTS. YOU ACKNOWLEDGE THAT THE PRODUCTS ARE NOT DESIGNED TO BE USED BY CHILDREN UNDER THE AGE OF [3] AND MAY CONTAIN SMALL PARTS.
YOU MUST ALSO MAKE YOUR OWN ASSESSMENT AS TO WHETHER THE PRODUCT IS SAFE AND SUITABLE FOR YOUR CHILD, OR THE CHILD YOU ARE PURCHASING THE PRODUCT FOR AS THE AGE OF 3 YEARS AND OLDER IS SUGGESTED ONLY. THE PRODUCTS ARE DESIGNED TO BE USED BY CHILDREN WITH THE SUPERVISION OF A RESPONSIBLE ADULT AT ALL TIMES.
IN ADDITION TO ALL OTHER LIMITATIONS AND DISCLAIMERS IN ON THIS SITE AND TO THE EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY, IN WHOLE OR IN PART, FOR ANY CLAIMS, LIABILITY, DAMAGES, LOSS OR COSTS ARISING FROM USE OF THE PRODUCTS.
Orders:
(a) You must check that the details of any order placed via this Site are complete and accurate before you submit it, as we will rely on the information provided. You can either order Product on a one-off basis or sign up to join the membership club to receive monthly Products.
(b) We are not bound to fill any order, until we accept such order in our sole discretion. If we do not accept your order, we will let you know and either offer you a refund or suggest substitute Product. If you do not receive an email within 24 hours of placing your order, your order is accepted.
(c) Upon placement of an order, you will receive an email confirming payment. An additional email will be sent if your order is accepted and to confirm the order has been shipped with Toll Group, or such other carrier as we choose in our discretion from time to time, and provide a tracking number.
(d) If you wish to cancel an order before it has been shipped, you must contact us on kylie@togethertime.co.nz immediately. Orders that have been shipped, cannot be cancelled or amended.
(e) Orders will not be shipped until we receive full payment from you. The price for Products will be stipulated on our Site at the time you place the order. Shipping charges are additional and are also stipulated as you go through the order process. All prices are in NZD and include GST unless otherwise stated.
(f) We use Stripe as our online payment system and rely on Stripe to keep your financial information secure. Your credit card information is not stored or captured at any time on our Site or by Us.
(g) You agree that you are purchasing the Products for personal use only, and not for purposes of trade or business. If you wish to purchase Products for the purposes of trade or business, please contact us on kylie@togethertime.co.nz.
(h) You authorise us, or our agents, to access, collect retain and use any information about you obtained from your access to this Site (“Information”) for purposes of: marketing, providing Products on our Site and contacting you about your order. You shall have the right to request
a copy of your information from us, and request that we correct any incorrect information held.
Club Membership:
(a) Club membership is only available for New Zealand residents.
(b) If you register for a club membership, Products will be delivered to you on monthly basis, in exchange for payment as quoted on our Site when you sign up. Your membership will automatically renew on the monthly anniversary date of your club membership and your credit card will automatically be charged, without any additional notice, unless you terminate or pause your membership before this date.
For example, if you joined the club membership on 1 July, it will renew and your credit card will be charged on 1 August, 1 September etc. until you terminate or pause the club membership.
(c) We may increase the total amount payable for your club membership by providing you with notice in writing to the email address on record.
(d) You can change, pause, or cancel your membership at any time by logging in to the membership portal on our Site and changing your preferences. Your membership and all future Product shipments will be changed/paused/terminated from the date that we receive your preference change.
stFor example, if your membership renews on July 1 , but you do not change/pause/terminate
rdyour membership until July 3 , the change/pause/termination will not be effective for the July
1st period and your Product will still be shipped.
Delivery:
(a) Products will be posted to the address specified in your order.
(b) Timeframes for delivery of Product will vary depending upon the availability of Products, your address and our carrier. Any delivery dates provided are estimates only and you appreciate may be affected by circumstances beyond our reasonable control. .
(c) Products will be your responsibility and risk from the time they are posted to the address you provide to us when ordering. You are responsible for ensuring that someone is present to accept delivery. We will not be liable for any failure of postal delivery, delivery to the incorrect address (if it is the same address as the address that you provided to us when ordering) or any damage, loss or theft of Products at any time after they are posted by us.
(d) It is your responsibility to check the Products upon delivery for any damage or shortages, which shall be communicated to us within 7 days of delivery in accordance with these terms.
Returns:
We will not accept any returns of Product, refunds or Product exchanges. All Product sales are final.Damaged Product:
(a) If a Product or part of a Product arrives damaged (“Damaged Product”), you must contact us on kylie@togethertime.co.nz no later than 7 days after your order is delivered describing the Damaged Product and provide photos, if requested.
(b) Provided that we determine that your Product, or part of the Product, is a Damaged Product, your sole and exclusive remedy is that we will either:
(i) Issue you a refund for the Damaged Product and the shipping costs, if the whole Product is damaged; or
(ii) Replace the Damaged Product at our cost.
7. Product Shortages:
(a) If a Product arrives without all its parts, you must contact us on kylie@togethertime.co.nz no later than 7 days after your order is delivered describing the Product shortage. Provided that we determine that your Product order contains a Product shortage, your sole and exclusive remedy is that we will either:
(i) Ship you the missing Product at our cost; or
(ii) Ship the missing Product with your next scheduled or (if you are a club member), provided that the missing part is not fundamental to the Product.
